The European Commission had demanded that Apple pay more in taxes.
Apple and Ireland have won a major tax case this morning EU Court, where European Commission had demanded that the Irish authorities collect more than $ 100 billion in treasure from the American tech giant.
EU Court writes in its decision that it has annulled the EUcommission requirements from 2016. Here, Competition Commissioner Margrethe Vestager otherwise stated that the Irish authorities had for a long time favored Apple, which has its European headquarters in Ireland, with illegal tax benefits of up to DKK 100 billion.
Apple had according to commission study was allowed to pay between 1.00 and 0.005 percent in treasure in the period 2003 to 2014.
– Member States may not grant tax benefits to selected companies. It is illegal according to EU state aid rules, it sounded at the time from the Danish competition commissioner.
Therefore demanded EU Commission also that the Irish authorities should recover the many billions as well as almost nine billion kroner extra in interest.
Joy at Apple
But according to EU Court it has not been documented that it was illegal State aid, and therefore the decision has now been annulled.
It comes as no surprise to Apple, whose CEO, Tim Cook, has previously described the EUcommission decision as “pure political waffle”.
– This case is not about how much treasurewe pay, but about where we are required to pay it. We are proud to be the largest taxpayer in the world as we know how important a role taxpayers play in society, Apple wrote in a statement, according to Reuters.
The case is one in a series of major tax cases, which EU Commission has started against multinational companies that make a lot of money – but pay little treasure – in Europe.
However, the decision can be appealed.
