Police have confiscated the car from the insane motorist’s girlfriend

A 34-year-old woman loses her car because her 36-year-old boyfriend was driving insane in it.

For the first time, an owner gets his car confiscated, even though it was someone else who was convicted of driving insane in the car. This is decided by the Court in Glostrup.

Thus, a 34-year-old woman now stands to lose her black Mazda CX-3. It is not more than ten months ago that she had to borrow almost 200,000 kroner to buy it.

It was her 36-year-old boyfriend who had borrowed the car. He had driven 108 kilometers per hour in a densely populated area in Rødovre, where you can only drive 50 kilometers per hour.

At the same time, the 36-year-old boyfriend is sentenced to 20 days unconditional imprisonment. He asked for time to consider appealing the case to the High Court.

The incident in question happened just three days after a new rule came into force. It meant that the police had to seize a car that had been used for insane driving for the purpose of confiscation.

The couple’s defense lawyer, Dorthe Fuglsang, has previously stated that a confiscation is a violation of constitutional property rights.

Prosecutor Charlotte Møgelhøj said on Thursday that she believes that the court has ruled in accordance with the Folketing’s intention when it passed the law on confiscation in insane driving.

– As I see it, it is in accordance with the rules that the Folketing has adopted, and that is what the court must decide on, and which we work according to, she says.

Since the car needs to be confiscated, it ends up at a police auction. The money from the sale goes to the Treasury.

On 3 June, the National Police was able to state that 171 cars have been seized for confiscation since 31 March. Of these, 70 are owned by someone other than the motorist. One of the cars has now been confiscated with today’s verdict.
